Po&nbsp;pod\u00e1n\u00ed ohl\u00e1\u0161en\u00ed m\u00e1 stavebn\u00ed \u00fa\u0159ad povinnost vydat souhlas do&nbsp;30 dn\u00ed, t\u00edm vznik\u00e1 velk\u00e1 \u010dasov\u00e1 \u00faspora a&nbsp;u\u0161et\u0159\u00ed se&nbsp;tak\u00e9 na&nbsp;spr\u00e1vn\u00edch poplatc\u00edch, pokud je&nbsp;pod\u00e1n\u00ed \u00fapln\u00e9. Aby&nbsp;bylo zjednodu\u0161en\u00e9 \u0159\u00edzen\u00ed mo\u017en\u00e9, je&nbsp;vy\u017eadov\u00e1n souhlas 3. osob (souhlasy v\u0161ech majitel\u016f sousedn\u00edch parcel). P\u0159i&nbsp;spln\u011bn\u00ed v\u0161ech podm\u00ednek pro&nbsp;zjednodu\u0161en\u00e9 \u0159\u00edzen\u00ed se, i&nbsp;p\u0159esto doporu\u010duje ov\u011b\u0159it si na&nbsp;stavebn\u00edm \u00fa\u0159ad\u011b v\u00e1\u0161 konkr\u00e9tn\u00ed z\u00e1m\u011br, existuj\u00ed v\u00fdjimky, kdy&nbsp;je&nbsp;nutn\u00e9 postupovat slou\u010den\u00fdm \u0159\u00edzen\u00edm.<br \/>\nUzemn\u00ed souhlas je&nbsp;vyd\u00e1v\u00e1n m\u00edsto \u00fazemn\u00edho rozhodnut\u00ed na&nbsp;stavby ur\u010den\u00e9 pro&nbsp;bydlen\u00ed a&nbsp;rekreaci bez ohledu na&nbsp;jejich v\u00fdm\u011bru, d\u0159\u00edve byl&nbsp;omezen maxim\u00e1ln\u00ed v\u00fdm\u011brou 150&nbsp;m2. Stavebn\u00ed povolen\u00ed ani ohl\u00e1\u0161en\u00ed nyn\u00ed nepot\u0159ebuj\u00ed sklen\u00edky, baz\u00e9ny nebo t\u0159eba v\u00fdrobky pln\u00edc\u00ed funkci stavby i&nbsp;s&nbsp;jejich z\u00e1kladovou konstrukc\u00ed*.<\/li>\n<li><strong> Slou\u010den\u00ed jednotliv\u00fdch povolovac\u00edch proces\u016f do&nbsp;jednoho \u0159\u00edzen\u00ed<\/strong>, existuj\u00ed t\u0159i typy integrovan\u00fdch postup\u016f. Pro&nbsp;realizaci z\u00e1m\u011br\u016f typu rodinn\u00fd d\u016fm nen\u00ed povinn\u00e9 vyu\u017e\u00edt spole\u010dn\u00e9 postupy, ka\u017ed\u00fd stavebn\u00edk si vol\u00ed s\u00e1m na&nbsp;z\u00e1klad\u011b konkr\u00e9tn\u00edch okolnost\u00ed, zda chce tento nov\u00fd typ \u0159\u00edzen\u00ed vyu\u017e\u00edt.\n<ul>\n<li><strong>1. typ &#8211; \u00dazemn\u00ed \u0159\u00edzen\u00ed spojen\u00e9 s&nbsp;posuzov\u00e1n\u00edm vliv\u016f na&nbsp;\u017eivotn\u00ed prost\u0159ed\u00ed (EIA)<\/strong><\/li>\n<li><strong>2. typ &#8211; Spole\u010dn\u00e9 \u00fazemn\u00ed a&nbsp;stavebn\u00ed \u0159\u00edzen\u00ed<\/strong><\/li>\n<li><strong>3. typ &#8211; Spole\u010dn\u00e9 \u00fazemn\u00ed a&nbsp;stavebn\u00ed \u0159\u00edzen\u00ed spojen\u00e9 s&nbsp;EIA<\/strong><\/li>\n<\/ul>\n<\/li>\n<\/ol>\n<h2>Kolaudace<\/h2>\n<p>Velk\u00fdm t\u00e9matem a&nbsp;pro&nbsp;stavitele <a href=\"\/pojisteni-nemovitosti\/\">rodinn\u00fdch dom\u016f<\/a> v\u00edtan\u00e1 zm\u011bna nastala v&nbsp;kolaudov\u00e1n\u00ed staveb. <strong>Kolaudace neboli povolen\u00ed u\u017e\u00edv\u00e1n\u00ed stavby ji\u017e v&nbsp;p\u0159\u00edpad\u011b rodinn\u00fdch dom\u016f nebude v\u016fbec nutn\u00e1<\/strong> a&nbsp;nebude ani prov\u00e1d\u011bna z\u00e1v\u011bre\u010dn\u00e1 kontroln\u00ed prohl\u00eddka stavby, kter\u00e9&nbsp;se&nbsp;mnoz\u00ed stavitel\u00e9 ob\u00e1vali. D\u0159\u00edv\u011bj\u0161\u00ed forma s&nbsp;n\u00e1zvem \u201cozn\u00e1men\u00ed z\u00e1m\u011bru zapo\u010d\u00edt s&nbsp;u\u017e\u00edv\u00e1n\u00edm stavby\u201d byla zcela zru\u0161ena. <strong>Kolauda\u010dn\u00ed souhlas nebo kolauda\u010dn\u00ed rozhodnut\u00ed nad\u00e1le pot\u0159ebuj\u00ed jen:<\/strong>**<\/p>\n<ol type=\"a\">\n<li><strong>Stavby ve\u0159ejn\u00e9 infrastruktury<\/strong> &#8211; t\u011bmi jsou nap\u0159\u00edklad pozemn\u00ed komunikace, dr\u00e1ha, vodn\u00ed cesta nebo leti\u0161t\u011b.<\/li>\n<li><strong>Stavbu, jej\u00ed\u017e vlastnosti nemohou budouc\u00ed u\u017eivatel\u00e9 ovlivnit<\/strong> &#8211; t\u00edm se&nbsp;mysl\u00ed nap\u0159\u00edklad nemocnice, \u0161kola nebo divadlo, developersk\u00e9 projekty rodinn\u00fdch dom\u016f, prost\u011b objekty, o&nbsp;jej\u00ed\u017e vlastnosti a&nbsp;vzhled se&nbsp;staral projektant a&nbsp;budouc\u00ed u\u017eivatel nemohl ovlivnit ani vzhled, ale ani vybran\u00fd materi\u00e1l \u010di&nbsp;technologie. Tyto stavby se&nbsp;z&nbsp;d\u016fvod\u016f ochrany ve\u0159ejn\u00fdch z\u00e1jm\u016f mus\u00ed i&nbsp;nad\u00e1le kolaudovat.<\/li>\n<li><strong>Stavbu, u&nbsp;kter\u00e9&nbsp;bylo stanoveno proveden\u00ed zku\u0161ebn\u00edho provozu.<\/strong><\/li>\n<li><strong>Zm\u011bnu stavby, kter\u00e1&nbsp;je&nbsp;kulturn\u00ed pam\u00e1tkou.<\/strong><\/li>\n<\/ol>\n<p>Netvrd\u00edme, \u017ee&nbsp;se&nbsp;klasick\u00fd rodinn\u00fd d\u016fm nedostane do&nbsp;v\u00fd\u0161e uveden\u00fdch \u0161katulek, ale je&nbsp;to&nbsp;docela m\u00e1lo pravd\u011bpodobn\u00e9. P\u0159esto\u017ee se&nbsp;kolaudovat nemus\u00ed, stavebn\u00edci a&nbsp;dal\u0161\u00ed osoby, kter\u00e9&nbsp;se&nbsp;\u00fa\u010dastn\u00ed v\u00fdstavby maj\u00ed i&nbsp;nad\u00e1le povinnost plnit v\u0161e co&nbsp;jim ukl\u00e1d\u00e1 stavebn\u00ed z\u00e1kon a&nbsp;pr\u00e1vn\u00ed p\u0159edpisy, kter\u00e9&nbsp;se&nbsp;vztahuj\u00ed k&nbsp;jeho proveden\u00ed. Stavebn\u00ed \u00fa\u0159ady mus\u00ed prov\u00e1d\u011bt soustavn\u00fd dozor s&nbsp;c\u00edlem ochra\u0148ovat ve\u0159ejn\u00fd z\u00e1jem, pr\u00e1va a&nbsp;kontrolovat v\u0161echny osoby zda pln\u00ed povinnosti, kter\u00e9&nbsp;jim ze&nbsp;z\u00e1kona vypl\u00fdvaj\u00ed***.<br \/>\n<strong>N\u011bkolik povinnosti stavebn\u00edka podle \u00a7152 stavebn\u00edho z\u00e1kona:<\/strong><\/p>\n<ul>\n<li>mus\u00ed db\u00e1t na&nbsp;\u0159\u00e1dnou p\u0159\u00edpravu a&nbsp;proveden\u00ed <a href=\"\/pojisteni-nemovitosti\/\">stavby<\/a>, prov\u00e9st vyhodnocen\u00ed zkou\u0161ek a&nbsp;m\u011b\u0159en\u00ed, kter\u00e9&nbsp;p\u0159edepisuj\u00ed zvl\u00e1\u0161tn\u00ed pr\u00e1vn\u00ed p\u0159edpisy<\/li>\n<li>mus\u00ed opat\u0159it p\u0159edepsanou dokumentaci<\/li>\n<\/ul>\n<p>Za&nbsp;nepln\u011bn\u00ed povinnost\u00ed, kter\u00e9&nbsp;z\u00e1kon ukl\u00e1d\u00e1 a&nbsp;jsou p\u0159esn\u011b definov\u00e1ny, m\u016f\u017ee b\u00fdt ud\u011blena po\u0159\u00e1dkov\u00e1 pokuta a\u017e do&nbsp;v\u00fd\u0161e 200.000 K\u010d.<\/p>\n<h2>P\u0159id\u011blen\u00ed \u010d\u00edsla popisn\u00e9ho<\/h2>\n<p>Pokud stavbou vznikne nov\u00e1 budova, kter\u00e9&nbsp;se&nbsp;p\u0159id\u011bluje \u010d\u00edslo popisn\u00e9 nebo eviden\u010dn\u00ed dolo\u017e\u00ed se&nbsp;stavebn\u00edmu \u00fa\u0159adu podklady (uveden\u00e9 v&nbsp;\u00a7 121 stavebn\u00edho z\u00e1kona) a&nbsp;stavebn\u00ed \u00fa\u0159ad p\u00edsemn\u011b vyzve p\u0159\u00edslu\u0161nou obec k&nbsp;p\u0159id\u011blen\u00ed \u010d\u00edsla.<\/p>\n<h2>Gar\u00e1\u017e, baz\u00e9n, plot<\/h2>\n<p><strong>Gar\u00e1\u017e<\/strong> se&nbsp;zastav\u011bnou plochou a\u017e 70m2 (d\u0159\u00edve jen&nbsp;50&nbsp;m2) m\u016f\u017ee tak\u00e9 podl\u00e9hat zjednodu\u0161en\u00e9mu \u0159\u00edzen\u00ed, o&nbsp;n\u011bm\u017e jsme hovo\u0159ili na&nbsp;za\u010d\u00e1tku.<br \/>\n<strong>Baz\u00e9ny<\/strong> byly za\u0159azeny do&nbsp;kategorie staveb, jej\u00ed\u017e realizace nemus\u00ed b\u00fdt v\u016fbec projedn\u00e1na se&nbsp;stavebn\u00edm \u00fa\u0159adem. Maxim\u00e1ln\u00ed rozloha je&nbsp;st\u00e1le 40m2, ale po&nbsp;novele je&nbsp;pamatov\u00e1no i&nbsp;na&nbsp;technick\u00e9 p\u0159\u00edslu\u0161enstv\u00ed k&nbsp;baz\u00e9nu jako jsou \u010derpadla a&nbsp;podobn\u011b****. Podm\u00ednkou je&nbsp;dodr\u017een\u00ed odstupu 2m od&nbsp;hranice va\u0161eho pozemku.<br \/>\n<strong>Plot<\/strong> &#8211; do&nbsp;v\u00fd\u0161ky maxim\u00e1ln\u011b 2 metry a&nbsp;nehrani\u010d\u00edc\u00ed s&nbsp;ve\u0159ejn\u011b p\u0159\u00edstupnou komunikac\u00ed, nepot\u0159ebuje \u00fazemn\u00ed souhlas.<\/p>\n<h2>Z\u00e1v\u011br<\/h2>\n<p>Teoreticky novela stavebn\u00edho z\u00e1kona snad p\u0159inese sp\u00ed\u0161e dobr\u00e9 zm\u011bny, kter\u00e9&nbsp;skute\u010dn\u011b povedou ke&nbsp;zrychlen\u00ed cel\u00e9ho procesu v\u00fdstavby.
